THE U.S. SUPREME COURT WILL NOT OVERRULE AND OVERTURN THE LEGITIMATE ELECTORAL MANDATE OF THE PEOPLE
BY KABS KANU
The United States is a country of laws and systemic checks and balances, unlike an unprogressive country like Sierra Leone and other Third World countries where legal, social and economic institutions are not only weak, and lack character and credibility but are also irredeemably corrupt and partisan, controlled by the political party in power
The Supreme Court is the final arbiter of law in the land, but powerful as it is. It will not blindly follow President Donald Trump and overturn the legitimate electoral mandate of the people just because majority of the justices of the court were appointed by Republican-led governments.
There must be a legitimate cause for the Supreme Court to intervene and annul elections results. Therefore, if President Trump is harboring any illusion that the Supreme Court give him the relief he demands—-change the results of the presidential elections and put him back in the White House—he does not know how the legal system works in his country.
The Supreme Court will only act based on credible evidence President Trump will have to provide irrefutable evidence and proof that the presidential election was rigged in favor of his opponent, Joe Biden. Mere allegations will not suffice .
People keep saying that from the look of things and the likelihood that President Trump may never concede, the Supreme Court may have to decide this 2020 presidential elections. True though it could be, this does not mean that the Supreme Court will act in a blind and partisan fashion to help President Trump in his vainglorious scheme not to leave the White House, even when he has been clearly defeated . The Supreme Court will rule, based on the facts and the evidence.
The Supreme Court has all the legal power but will be less inclined to undermine and overthrow America’s electoral processes and mandate just to please a president who wants to cling to power illegitimately. The reason is that unlike Sierra Leone and Third World countries. America is a country of systems. Every system seeks to complement and enhance the efficacy of the other system.
President Trump will not be able to provide credible evidence that the whole election was rigged and skewed in favor of Democratic candidate, Joe Biden . Republican governors, mayors and Secretaries of State helped preside over the elections especially in the key decisive states of Georgia and Pennsylvania. He will not be able to provide evidence that the whole election was rigged and thus have the whole results overturned . But let us assume that he prevails in having the results overturned, the Supreme Court will not then hand the victory to him. That is not the way the system works. In the worst case scenario, the Supreme Court would order a rerun and Biden would beat him again if the election is held a second time.
President Trump must know that the results are a repudiation of him. Americans just do not want him to be their president again.
Even if he prevails in having results thrown out in some states because of procedural errors in the conduct of the elections, this will not affect the final results because Joe Biden has many other pathways to gaining the mandated 270 electoral votes , with the way things stand now. He will ultimately win, even without Georgia or Pennsylvania because he is also winning in Arizona and Nevada, states that would also decide the race.
The worst that President Trump can do is delay the declaration of Joe Biden as the legitimate winner of the 2020 presidential election.
